Publisher Terms
Effective date: 22 October 2026
These Publisher Terms are an agreement between you and ThoughtPivot, Inc, a US corporation at 2937 East Grand Boulevard, Detroit, MI 48202, United States, the operator of Bytewells at https://bytewells.com/. They apply when you publish an Actor on the Store, or keep one published.
They add to the Terms of Service. If these Publisher Terms and the Terms of Service disagree about publishing or payouts, these Publisher Terms control. The Terms of Service still govern your use of Bytewells as a customer. The Privacy Policy explains account and billing data. The Data Processing Addendum covers personal data a customer puts into a run or into storage.
Publishing a listing, or leaving a listing published, agrees to these Publisher Terms.
What you can publish
Publishing is optional. You can keep the same Actor on Apify or anywhere else. Bytewells does not ask for exclusivity.
You set the monthly price, the trial length, and any pass prices. The trial can be from none up to 30 days. The default is 3 days.
You are responsible for the Actor: that you have the right to publish it, that the listing matches what it does, and that it is not malware and does not steal credentials. The acceptable-use rules in the Terms of Service apply to the Actor and to your account.
A renter's name, email, runs, inputs, and outputs are not shared with you.
License
You keep ownership of your source. You grant ThoughtPivot, Inc a license to host it, build it, store the build, run the built image for customers who are entitled to that Actor, and display the listing, including the name, description, and images you provide.
Customers run the built image. We do not hand them your source. We may inspect the source when we need to for legal, compliance, or security reasons, including malware, cryptocurrency mining, and a listing that does not match the Actor.
Price lock
A later price change applies to new rentals. A rental a customer already has keeps the price and commission rate it started with. We do not require you to switch that rental to another pricing model.
Commission and fees
Bytewells keeps 10% of each rental and pass charge. The commission is 0% on customers you refer, and 0% while your account is in a Founding Developer window shown in the console. Any other rate has to be on the account before the rental starts. The rate that applies is the rate locked when that rental or pass charge starts.
Stripe's card and billing costs on the charge are passed on to you at cost, with no markup, and the rest is yours. Bytewells pays the fixed Stripe Connect account and payout fees. Compute charges pay for the runtime and are not split with you.
Payouts
Your earnings accrue as you sell and become payable 14 days after each payment. We pay them out once a month through Stripe when your payable balance reaches $50. Smaller balances roll over.
You can publish a paid listing before you verify with Stripe, but you must complete the identity and bank checks Stripe asks for to receive a payout. Payouts are available for accounts in the European Union, Liechtenstein, Norway, Switzerland, and the United Kingdom. Paid listings are not available elsewhere yet.
If a balance of $50 or more stays unpaid for 90 days because Stripe verification is incomplete, new rentals and pass sales on your Actors pause until you finish it. Rentals and passes already paid for keep running. Refunds and lost disputes on a sale are deducted from your earnings.
Taxes
You are responsible for taxes on your earnings, including income tax. Stripe may require tax information before it will pay you. You are not an employee of ThoughtPivot, Inc.
ThoughtPivot, Inc is the seller of the rental, the pass, and the compute. The customer's card is charged on our Stripe account. Your share is a transfer to your Stripe account once a month, after the hold above. You do not charge the customer's card. If we have to collect a tax on what the customer pays, that tax is not part of your earnings.
Takedown
We can unpublish or suspend a listing that breaks these terms, the Terms of Service, or the law, or that creates a security risk. We will tell you when we can do that without making the risk worse.
You can unpublish at any time. Unpublishing stops new sales. A rental or pass already paid for keeps running until the end of the period already paid for, unless we have to stop it for a security or legal reason.
Liability
The liability limits in the Terms of Service apply to these Publisher Terms.
Changes
If these terms change, the effective date at the top of this page changes with them. Keeping a listing published after that date means the new terms apply. If a change affects a rental a customer is already paying for, the notice rules in the Terms of Service apply.
